AWARD

The reference in this case involves the dismissal of Dimin bin Damsik & 43 Others ("the claimants") by Karamunsing Hotel Sdn. Bhd. ("the company").

The case was partly heard on 6 May 2004; 7 May 2004; 27 May 2004; 9 July 2004.

After mediation process the parties on 13 December 2004 duly informed the court that they had amicably reached and agreed to a full and final settlement sum of RM245,000 (Ringgit Malaysia Two hundred and forty Five Thousand) in respect of the claimants' claim herein and this is to be paid in 2 installments in the following manner:

(1) the first installment payment by cheque dated 2 January 2005 for the sum of RM122,500 by cheque dated 3 January 2005; and

(2) the second installment payment for the sum of RM122,500 by cheque dated 1 February 2005.

Both cheques as mentioned in items (1) and (2) are to be made payable to Messrs Sugumar & Co. The said cheques together are to be delivered to Messrs Sugumar & Co. on 3 January 2005 by Messrs Chin Lau Wong & Foo.
