The court emphasized that the Defendants’ actions posed safety risks and undermined the authority’s statutory duties, justifying the issuance of an interim injunction (!) (!) .

Furthermore, the court acknowledged the availability of criminal proceedings but noted that the Defendants continued their unlawful activities despite these measures, reinforcing the need for injunctive relief (!) (!) . The decision was grounded in the balance of convenience, which favored preventing further unlawful construction to protect public safety and uphold statutory compliance (!) (!) .

Ultimately, the court granted an interim injunction restraining the Defendants, their employees, or agents from occupying, using, or continuing any construction or extension works on the premises until the final determination of the case or further orders (!) .


JUDGMENT

This is an appeal by the Appellants ("the Defendants") against my decision given on 24 August 2001 wherein I granted the application of the Respondent ("the Plaintiff) for an interim injunction against the Defendants.

By a summons-in-chambers (Encl. 3) dated 10 January 2001 the Plaintiff prayed for, inter alia :

(1) Suatu perintah injunksi untuk menahan Defendan-Defendan samada dengan sendiri atau menerusi pekerja-pekerja/pengkhidmat mereka atau ejen-ejen mereka atau setiap daripada mereka atau melalui apa-apa cara lain daripada menduduki, menggunakan, meneruskan atau membenar kerja-kerja pembinaan dan penambahan kepada premis No. 237-B, Jalan Sungai Rusa di atas Lot 781, Mukim C, Daerah Barat Daya, Permatang Pasir, Pulau Pinang tanpa kebenaran Plaintif hingga penyelesaian perbicaraan guaman ini atau sehingga perintah selanjutnya.

The said application is supported by the affidavit of Patahiyah bte. Ismail, who is the Pengarah Bangunan Plaintif, affirmed on 10 January 2001 (Encl. 2).

An Affidavit Balasan was affirmed by the Defendants on 29 January 2001 (Encl. 5).
