This is an appeal by the Appellants ("the Defendants") against my decision given on 24 August 2001 wherein I granted the application of the Respondent ("the Plaintiff) for an interim injunction against the Defendants.

By a summons-in-chambers (Encl. 3) dated 10 January 2001 the Plaintiff prayed for, inter alia,

(1) Suatu perintah injunksi untuk menahan Defendan-Defendan samada dengan sendiri atau menerusi pekerja-pekerja / pengkhidmat mereka atau ejen-ejen mereka atau setiap daripada mereka atau melalui apa-apa cara lain daripada menduduki, menggunakan, meneruskan atau membenar kerja-kerja pembinaan dan penambahan kepada premis No. 237-B, Jalan Sungai Rusa di atas Lot 781, Mukim C, Daerah Barat Daya, Permatang Pasir, Pulau Pinang tanpa kebenaran Plaintif hingga penyelesaian perbicaraan guaman ini atau sehingga perintah selanjutnya.

The said application is supported by the affidavit of Patahiyah bte. Ismail, who is the Pengarah Bangunan Plaintif, affirmed on 10 January 2001 (Encl. 2).

An Affidavit Balasan was affirmed by the Defendants on 29 January 2001 (Encl. 5).
