2011 MarsdenLR 1139

ROSLAN MAT NOR
SUA JUAN HAN & SATU LAGI – Appellant
Versus
POK BROTHERS (JOHOR) SDN BHD – Respondent

The principle of res judicata is inapplicable in industrial adjudication; the court must prioritize substantive justice over technicalities.

Headnote:(A) Principle of Res Judicata - The court addressed the applicability of res judicata in the context of an industrial dispute. Relevant sections include Section 30(5) of the Industrial Relations Act 1967. The court referred to various case laws, confirming that the issues raised in this proceeding were not substantially the same as those in previous litigation. (Paras 1-6)

(B) Estoppel in Industrial Adjudication - The doctrine of estoppel, particularly res judicata, does not apply in industrial proceedings, focusing instead on equitable resolutions without technicalities (Paras 6)

(C) Jurisdiction of the Court - The court emphasized the importance of determining its jurisdiction before proceeding with hearings on the merits of the case (Paras 5 and 6).

Facts of the case:
The respondent raised a preliminary objection claiming the current case mirrors a previously decided case, while the claimant asserted fundamental differences exist, particularly in the nature of the claims.

Findings of Court:
The court found that key issues were indeed distinct enough to allow the case to proceed.

Issues: The main issues involved were whether the current issues overlapped significantly with a previous decision and the jurisdiction of the court related to those issues.

Ratio Decidendi: The court ruled that res judicata does not apply in this context since the matters in question are not identical. Moreover, it asserted the jurisdiction of the court must be clarified before substantive hearings (Paras 5 and 6).

Result: The preliminary objection was dismissed.

AWARD

Rayner and Keeler, Ltd and Others (1966) 2 All ER. 536 seperti berikut:

"The doctrine of estoppel per rem judicatam is reflected in two Latin maxims, (i) interest rei publicase ut sit finis litium and, (ii) memo debet bis vexare pro una et eadem causa. The former is public policy and the latter is private justice. The rule of estoppel by res judicata, which is a rule of evidence, is that where a final decision has been pronounced by a judicial tribunal of competent jurisdiction over the parties to and subject-matter of the litigation, any party or privy to such litigation as against any other party or privy is estopped in any subsequent litigation from disputing or questioning such decision on the merits (Spencer Bower On res judicata, p. 3)..."

Talasco Insurance Sdn. Bhd. & Anor di man
