In negligence cases, the ownership of the vehicle is prima facie evidence of liability; the absence of defense evidence can affirm this liability.
Headnote:(A) Tort Law - Road Traffic Accidents - The court found the defendant 100% liable due to absence of defense, awarding general damages of RM82,500.00, special damages of RM50.00, with interest rates of 8% and 4% on respective damages - The plaintiff provided credible evidence of the accident and defendant's involvement. (B) Liability - In cases of negligence, ownership of the vehicle is prima facie evidence against the owner unless disproven. This principle guided the court in affirming liability based on lack of evidence from the defense. (Paras 7, 8)

[1] Dalam kes ini pihak plaintif menuntut gantirugi am dan khas dari defendan atas kecederaan dan kerugian yang beliau alami akibat kemalangan jalanraya melibatkan kenderaan kedua-dua pihak. Setelah mendengar keterangan pihak plaintif, dengan ketiadaan pembelaan dari defendan kerana tidak hadir di mahkamah, mahkamah ini membuat keputusan bahawa defendan liable 100% dalam kemalangan ini. Mahkamah membenarkan gantirugi am RM82,500.00, gantirugi khas RM50.00 dengan kos dan faedah 8% setahun atas gantirugi am dari tarikh pemfailan saman ke tarikh penghakiman, dan 4% setahun atas gantirugi khas dari tarikh kemalangan ke tarikh penghakiman, dan selepas itu 8% setahun atas jumlah penghakiman dari tarikh penghakiman ke tarikh penyelesaian penuh.
