The Plaintiff's Case Against The 1st Defendant ("D1")

[1] The plaintiff's case against D1 is for the false misrepresentations made by D1 which the plaintiff had relied on and which had induced the plaintiff into paying the sum of RM5.5 million to D1 on 19 May 2010.

[2] In inducing the plaintiff to part with RM5.5 million, D1 made, amongst others, the following representations to the plaintiff:

(a) he would be able to assist in obtaining and/or expediting the plaintiff's claim against the Ministry of Defence ("MoD") for the sum of RM26,638,727.96, being rental owing by MoD for the use of the plaintiff's land described as GRN 92741, Lot No 3, Mukim Sungai Petani, Kuala Muda, Kedah ("the said land");

(b) that he was able to do so because he was a reputable businessman, being the grandson of Tan Sri Devaki Krishnan, a well known politician in the Malaysian Indian Congress ("MIC");

(c) he was able to communicate with the MoD directly due to his close relationship with the MoD at the material time;

(d) D1 also showed the plaintiff, an unsigned letter dated April 2010 purportedly from the MoD, approving payment of the plainti
