AWARD NO. 209 OF 1997 [6 MAY 1997]

On 5 January 1994 the Industrial Court Award handed down No. 12 of 1994 in favour of the claimant on a claim of dismissal without just cause or excuse.

The employer, Malaysian Sheet Glass Bhd., being dissatisfied with the Industrial Court's decision took the matter to the High Court by way of certiorari. One of the Employer's ground in seeking the relief from the High Court is as follows:

The Industrial Court erred in law and acted in excess of jurisdiction in making a finding that the Respondent was arrested by the Police on 23 August 1991 in total disregard to the confirmation of the arresting authority (exh. CO5).

On 5 January 1995 the High Court made the following order:

Adalah diperintahkan bahawa Award Mahkamah Perusahaan No. 12 tahun 1994 dalam kes No. 4/4-189/92 dengan ini dibatalkan Dan Selanjutnya Diperintahkan bahawa kes ini dihantar balik ke Mahkamah Perusahaan dengan satu arahan supaya Pengerusi Mahkamah Perusahaan yang sama menimbangkan sekali lagi (re-evaluate) keterangan dan untuk mencapai satu keputusan menurutnya.

On 5 February 1997 when the case came up for re-evaluation of the evidence this Court allowed both Counsel to make further
