Rujukan ini di bawah Seksyen 20(3) Akta Perhubungan Perusahaan 1967 oleh Y.B. Menteri Sumber Manusia adalah berpunca daripada pembuangan kerja ke atas Encik Mohamad Fauzi bin Shamsul Anuar, Pihak Menuntut, pada 23 Oktober 2007.

Kes ini telah dibangkitkan untuk perbicaraan pada 20.3.2009 dengan kehadiran Encik R. Harikannan dari Tetuan Jayadeep Hari & Jamil., peguamcara yang mewakili Pihak Menuntut dan Tuan Haji Zaikon bin Jaafar dari M.E.F., yang mewakili Pihak Responden. Wakil Responden, Encik Ahmad Masdar bin Che Lah, Pengurus Pembangunan & Pemasaran turut hadir. Encik R. Harikannan memaklumkan Mahkamah bahawa kedua-dua pihak telah berjaya mencapai penyelesaian damai di dalam kes ini menurut terma-terma persetujuan seperti yang terkandung di dalam "Memorandum of Agreement" bertarikh 20.3.2009 yang dikemukakan dan ditandakan oleh Mahkamah sebagai Eksibit "A".

Tuan Haji Zaikon bin Jaafar mengesahkan terma-terma penyelesaian tersebut.

Maka, Mahkamah dengan ini menurunkan Award menurut terma-terma penyelesaian seperti yang terkandung di dalam Eksibit "A" yang berkelat bersama-sama Award ini yang dipersetujui oleh kedua-dua pihak di dalam kes ini.

MEMORANDUM OF AGREEMENT

THIS AGREEMENT is made this 20th Day of March 2009 between Sipro Plastic Industries Sdn Bhd (hereinafter referred to as "the Company") on the one part and Mohamad Fawzi Bin Shamsul Annuar (hereinafter referred to as "the Claimant") of the other part.

WHEREAS the Parties heretofore agree as follows:-

1. The Company agrees to pay to the Claimant the sum of Ringgit Malaysia Twenty Five Thousand and Two Hundred (RM25,200.00) only as full and final settlement of all claims under Industrial Court Case No: 5/4-557/08 without admission of liability.

2. The Claimant agrees to accept the aforesaid sum of RM25,200.00 and further declares that he shall have no further claim whatsoever against the Company and the Company is hereby discharged of all liabilities.

3. The aforesaid sum of RM25,200.00 shall be paid by the Company to the Claimant through the Claimant's Solicitors on or before 20 April 2009 subject to the Claimant having obtained tax clearance from the Lembaga Hasil Dalam Negeri.

4. The Parties heretofore agree to deposit this Agreement with the Honourable Court to be entered into as consent Award of the Court.
