STRIKING OFF

This case was originally registered as Case No. 1/1-705/02 but now re-registered as Case No. 12(1)/1-705/02 for the purpose of this Award.

The case was fixed for Hearing in Tawau, Sabah on 16.12.2002 but subsequently postponed to a date to be fixed. Since then there has been no development.

On 24.3.2006 the Court wrote a letter to the Complainant inquiring whether he is still interested to pursue this matter. The Complainant was further informed that if the Court does not receive any reply from him with 1 month the Court would strike off the case.

On 5.5.2006 the Post Office returned the above letter with the remark on the A.R. card, "Tidak Dituntut/Unclaimed".

The Company's Solicitors, Messrs Hiew and Chin, was served with the Court's same letter on 4.4.2006 but they did not respond in any way.

Since the Complainant cannot be traced, the Court struck off this case with liberty to the Complainant to apply for reinstatement of the case within 3 months from the date of this Award.
