JUDGMENT

Jeffrey Tan J:

Trial commenced against the accused on the following charge.

Bahawa kamu pada 6.5.2000 jam lebih kurang 8.45 malam di lorong belakang Restoran Banafe Jalan Abdullah di dalam Daerah Muar, di dalam Negeri Johor Darul Takzim telah melakukan kesalahan BUNUH dengan menyebabkan kematian Chandrashekar a/l Ponusamy (No. KPT 550911-01-5331) iaitu satu kesalahan yang boleh di hukum di bawah Seksyen 302 Kanun Seksaan."

11 witnesses testified for the prosecution. Their testimony may be summarised as follows. At 9.01 pm, on 6 May 2000, Inspector Cyril Edward (SP1, who was on duty at the Bilik Gerakan IPD Muar) received a telephone call from a member of the public who said that 2 persons of Indian descent had been stabbed, at Jalan Abdullah near Sahara Hotel. Having reduced that information into Muar Report 3080/00 (P4), he then informed Chief Inspector Idris bin Abdul Rahman (SP11) of that report.

SP11 testified that SP1 informed him of P4, at about 9.10 pm on 6 May 2000. He proceeded to the scene with a police photographer (SP3 - Lance Corporal Abdul Malek bin Ismail) and Lance Corporal Razman bin Nikmat. They reached the back of Restoran Banafe, Jalan Abdullah at 9.20
