AWARD

The parties to the dispute are Makro Cash & Carry Distributions (M) Sdn. Bhd. (hereinafter referred to as the company) and Eddy Kusmizan bin Abd. Manan & Five Others (hereinafter referred to as the claimants).

This case was set down for mention on 20 December 2004. Upon the case being called up for mention; the court was informed that the dispute has been amicably settled.

The terms of the settlement are as follows:

Whereby the parties involved are Makro Cash & Carry Distributions (M) Sdn. Bhd. (hereinafter known as 'the company') and Eddy Kusmizan bin Abd. Manan & Five Others (hereinafter known as 'the claimant') whereby the company is represented by Mr. Ramesh Vesan from M/s Ramesh Vesan & Co. and whereby the claimant is represented by Mr. Darshan Singh of Malaysian Trade Union Congress Johor Division hereby agree and consents to the terms and conditions as follows:

1. That the company hereby consent without admission of liability to pay the claimant the sum of RM186,500 as full and final settlement of the case.

2. The claimants award on a individual basis are as follows:

(a) Eddy Kusmizan bin Abd. Manan : RM18,000

(b) Thalji bin Kadri : RM46,000

(c) Fong Lai Man : RM38,000

(d) Aw Siew lloi : RM53,000

(e) Siti Sapiah binti Ramli : RM20,000

(f) Siti Rohana binti Puasa : RM10,500

(3) The claimants involved shall not and is hereby harred from instituting any claims whatsoever against the company upon receipt of the said sum of monies stipulated in para. 1.

(4) The payment of the said sum of monies stipulated in para. 1 shall be made payable through "Kongres Kesatuan Sekerja Malaysia" within (14) days from the date of this consent order.

(5) That the company hereby agrees to expunge all records and documents in relation to the claimant's termination and/or dismissal.

(6) That parties hereinbefore agrees to comply with the terms and conditions stipulated hereinbefore.
