2011 MarsdenLR 2443
ROSLAN MAT NOR
GURMAIL KAUR S NAZAR SINGH – Appellant
Versus
PALM RESORT BERHAD – Respondent
The employer must substantiate claims of redundancy with clear evidence to justify termination, ensuring compliance with fair labor practices.
Headnote:(A) Industrial Relations Act, 1967 - Right to fair retrenchment - Company failed to prove redundancy as a genuine reason for termination of employment. (Paras 11, 12, 17)
(B) Employment contract - Employer's discretion to restructure does not exempt obligation to demonstrate bona fide redundancy. (Paras 12, 17)
(C) Evidence - Burden of proof lies on the employer to substantiate claims of redundancy definitively. (Paras 11, 12)
Facts of the case:
The claimant was employed as a Golf Course Superintendent, terminated on grounds of retrenchment due to financial losses. Respondent claimed restructuring, citing outsourcing as the reason. (Paras 1, 2, 5, 10, 17)
Findings of Court:
The Court found that the respondent did not provide sufficient evidence for the claimed redundancy vital for termination legitimacy. (Paras 16, 17)
Issues: Whether the claimant's employment termination was justified under redundancy and the procedural validity of the retrenchment process. (Paras 12, 18)
Ratio Decidendi: The court concluded the respondent did not adequately substantiate claims of redundancy to justify the termination of the claimant's employment, thus making the dismissal unjustified. (Paras 12, 17)
Result: Claimant entitled to back pay and compensation totaling RM47,616.00, to be paid within 40 days.

ANNOUNCEMENT ON outsourcing OF GOLF COURSE MAINTENANCE
1. Introduction
(a) The lack of financial resources to acquire new and better machineries and equipment has severely affected the maintenance of our 3 golf courses, and consequently it has been necessary for the company to source for a third party contractor to provide maintenance of the golf courses.
(b) The third party contractor will be required to provide, at its own cost and expense, certain minimum machineries and equipment and certain minimum manpower, to carry out the said maintenance of the golf courses.
(c) In line with other golf course operations in Malaysia and all over the world, we need to reorganize ourselves in order to remain competitive in the market and the immediate target is:
(i) to relieve the company from the need to incur a future capital costs investment (replacement of machineries and equipment) estimated at about RM4 Million over the next 5 years; and
(ii) to immediately reduce our overall golf course maintenance costs by at least 13%.
2. The Proposed Plans
In the event that the outsourcing of the golf course maintenance shall be successfully concluded, the company will be taking the appropriate measures in respect of its employees at the Golf Course Maintenance (GCM) Department, which will include:
(a) the termination of service of contract workers involved in golf course maintenance;
(b) r
