[1] In this present suit, the plaintiff bank is proceeding only against the 2nd defendant in his capacity as a Guarantor for a Banking Facility (an overdraft of RM3 million) granted by the plaintiff to a company named Diam Ubi Sdn Bhd by a Letter of Offer dated on or about 4 December 1979. The relevant Letter of Guarantee, which appears from pp 6 to 9 of the Common Bundle of Documents, is dated 17 December 1979.
