[1] This case was referred to the Industrial Court by the Honourable Minister of Human Resources pursuant to subsection 20(3) of the Industrial Relations Act 1967 ("IRA") arising out of the dismissal of Chong Peng Fai ("1st Claimant") by CIMB Bank Berhad ("Company") on 11 November 2008. Subsequently, pursuant to Industrial Court Interim Award No 455 of 2013 dated 14 March 2013, this case was consolidated with case no 26(19)/4- 540/11 which was referred to the Industrial Court by the Honourable Minister of Human Resources pursuant to subsection 20(3) of arising out of the dismissal of Fauziah binti Amir ("2nd Claimant") by the Company on 10 November 2008.

[2] In this case, the statement of case of the 1st Claimant (SOC1) was filed on 10 August 2010, the statement of case of the 2nd Claimant (SOC2) was filed on 8 September 2011, the statement in reply to the SOC1 was filed on 5 October 2010, the statement in reply to the SOC2 was filed on 17 November 2011, the rejoinder of the 1st Claimant was filed on 9 November 2010, the 1st Claimant's bundle of documents (CLB1) was filed on 10 August 2010, the 2nd Claimant's b
