ALI JEMAN – Appellant
Versus
INDRANIKA JAYA SDN BHD & ORS – Respondent
[Suit No: KCH-22-71-8-2013]

Petitioner Advocates:Dominique Ng ,Respondent Advocate: Peter Hii

The burden of proof for establishing Native Customary Rights lies with the claimant, requiring credible evidence of continuous occupation and adherence to statutory requirements.

Headnote:In interpreting the provisions of the Sarawak Land Code, the court examined the claims for Native Customary Rights made by the plaintiff on behalf of his family. The plaintiff contended continuous occupation since 1958 based on family history, supported by witness testimonies. However, the court found insufficient evidence particularly regarding the legal establishment of such rights, highlighting the necessary burden of proof. The judgment concluded that the plaintiff failed to substantiate claims against the defendants adequately, dismissing the case entirely.
