Introduction

[1] This is an application by the respondent by way of summons in chambers in encl. 6 under r. 102(1) of the Divorce and Matrimonial Proceedings Rules 1980 and O. 18 r. 19 of the Rules of the High Court 1980 ("RHC 1980") praying for the following orders:

(1) that the petition for divorce dated 27 April 2009 filed on 6 May 2009 herein be struck out on the grounds that:

(a) it is scandalous, frivolous or vexatious; or

(b) it is otherwise an abuse of the process of this honourable court.

(2) that the whole of the divorce proceeding herein be stayed pending the determination of the application herein;

(3) in the event prayer (1) is rejected, that the respondent be allowed to file her answer within twenty-one (21) days of the order herein;
