GROUNDS OF JUDGMENT

1. Enclosure 27 is the 2nd Defendant, Low Thiam Hock's appeal to the Judge in Chambers against dismissal by the learned Senior Assistant Registrar on 9-12-2005 of Enclosure 25 wherein the 2nd Defendant sought orders pursuant to Order 24 rule 12 and rule 13 of the Rules of the High Court 1980 ("RHC") as follows:

"1. The Plaintiff do within fourteen (14) days of service of this order produce for inspection by the 2 Defendant and/or his solicitors at the office of the 2nd Defendant's solicitors at Level 1A, Block B, Kompleks Pejabat Damansara, Jalan Dungun, Damansara Heights, 50490 Kuala Lumpur, the following documents, namely:-

a. All documents and credit papers in respect of the approval of the loan by the Plaintiff in favour of the 1st Defendant, including the Letter of Offer dated 25.1.1996;

b. All documents in respect of the opening of the account for the shares pledged pursuant to the Memorandum of Deposit of Shares dated 25.1.1996;

c. The list or schedule of shares pledged to the Plaintiff between 25.1.1996 and May 1998, in particular as at December 1997 and January 1998;

d. Details of the sale of the pledged shares, namely the date and value of any sale;
