This is a reference made under subsection 20(3) of the Industrial Relation Act 1967 arising out of the dismissal of Puan Lee Lai Ngor (hereinafter referred to as 'claimant') by Winston's Sdn. Bhd. (hereinafter referred to as the 'company') on the 24th September 2003.

AWARD

AT THE commencement of the hearing of this reference this morning 11th January 2008 the learned counsels appearing for the claimant and the company informed the court that the parties have mutually resolved the dispute by consent on the following terms.

1. The sum of RM20,000.00 will be paid to the claimant through her solicitor as an ex-gratia payment as full and final settlement of this matter on or before 25th January 2008.

2. Upon settlement of the above payment both parties agree that there is no further claim against each other.

3. This settlement is arrived without admission of liability by either party.

UPON confirmation of the said terms by the claimant the court accordingly handed down and award upon the terms as agreed to by consent indicated above.
