GROUNDS OF JUDGMENT

The accused is on trial for drug trafficking and the charge against him reads as follows:

"Bahawa kamu pada 27hb December 1991, jam lebih kurang 3.05 petang, di sebatang jalan tanah merah besebelahan dengan Taman Burung, Seberang Jaya, di dalam Daerah Butterworth, di dalam Negeri Pulau Pinang, telah memperedarkan dadah berbahaya, iaitu ganja seberat 392.9 gram dan dengan demikian kamu telah melakukan satu kesalahan di bawah Seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah Seksyen 39B(2) Akta yang sama."

The prosecution called 8 witnesses and closed its case on 3.7.1995. Both the prosecution and defence ended their submissions on 10.7.1995 with further [2] proceedings adjourned to this day for the court's decision whether to call for the defence.

The primary facts in the prosecution's evidence were as follows:

(a) at 3.05 p.m. on the 27.12.1991, a police party led by PPP Abu Shariman (SP2) was waiting in ambush beside a red earth road in the vicinity of Taman Burung, Seberang Jaya, Butterworth when they saw a motorcyclist riding a motor cycle (later said to be bearing registration number PCB 8404) passing by,

(b) one officer from the ambush party
