[1] These three appeals arose from the same suit. At the request of the parties, Civil Appeal No: W-02-199-2002 and Civil Appeal No: W-02-759-2002 were heard together (hereafter referred to as the 1st and 2nd appeals, respectively). Civil Appeal No: W-02-443-2002 was heard separately (hereafter referred to as the 3rd appeal).
The Suit
[2] On 28 May 2001, the appellant (the plaintiff in the court below) filed this action against the 1st respondent (the 1st defendant in the court below), a newspaper publishing company following an advertisement of a notice of substituted service of a bankruptcy notice directed against the appellant (hereafter referred to as "the said advertisement") which appeared in 22 January 2001 issue of "the Malay Mail", ie, the 2nd respondent (the 2nd defendant in the court below and hereafter referred to as "the Malay Mail"), an afternoon daily printed by the 1st respondent.
[3] The appellant claims that she is a well-known businesswoman who owns a registered business enterprise known as Golden Kintex and is also a director of several locally incorporated companies. She also claims that she is a well- known writer and a "Goodwill A
