LOW HOP BING
FEEDMEAL MALAYSIA SDN BHD – Appellant
Versus
TEH CHO YEOW – Respondent
Low Hop Bing J:
Applications
Before me are two summonses in chambers viz:
1. encl. (69) filed by the plaintiff for an order that pursuant to r. 28(a) of the Legal Profession (Practice and Etiquette) Rules 1978, the firm of solicitors Messrs Yap Koon Roy & Associates be barred from acting for the defendants; and
2. encl. (73) filed by the defendants under O. 14A read with O. 33 r. 2 of the Rules of the High Court 1980 for a determination as to whether the plaintiff haslocus standi to bring this action against the defendants.
Numerous consequential prayers have been sought by the parties herein but in essence the fundamental prayers set out above would no doubt effectively dispose of their respective applications.
Messrs Yap Koon Roy & Associates
Defendants' application in encl. (73) was originally filed by Messrs Yap Koon Roy & Associates, but written submission has now been filed by another firm of solicitors, Messrs H.S. Lee Chua & Partners, as solicitors for the defendant. This scenario has given rise to the irresistible inference that Messrs Yap Koon Roy & Associates have discharged themselves from acting or have evinced an intention of not desiring to act further as so
