The dispute emanates over the dismissal of the claimant by the hotel on 13 January 1994.

The claimant joined the hotel as a houseboy on 11 June 1985 (Exh. CL2) and was subsequently confirmed in his appointment vide letter of 9 October 1985 (Exh. CL4). He was subsequently promoted to doorman and then finally to concierge clerk (Exh. CL3). His last drawn salary was RM453 plus five service points with an average of RM120 per point which comes to a total of RM1,053 per month.

On 28 December 1993, the hotel issued a show cause letter to the claimant (Bundle "B1" p. 1). The said letter reads as follows:
