The doctrine of frustration does not apply if the contract remains fundamentally the same despite changed circumstances; failure to fulfill conditions leads to breach.
Headnote:This case discusses the plaintiff's claim for contract termination due to non-fulfilment of conditions precedent. The court finds that the contract was not frustrated on account of the plaintiff's inability to secure funding and concludes that the plaintiff breached the contract. It orders the forfeiture of the deposit and awards further damages. The contract remains valid despite the circumstances.
