MAHKAMAH RAYUAN PUTRAJAYA
CH-9 MEDIA SDN BHD & YANG LAIN LWN. IMTIYAZ VENDING (MARKETING) SDN BHD & SATU LAGI RAYUAN
[Rayuan Sivil No: W-02(NCVC)(W)-842-04/2021 & W-02(IM)(NCVC)-609-04/2021]

Petitioner Advocates:Mohamad Reza Abu Hassan,Nur Azureen Ibrahim ,Respondent Advocate: Noor Izzatie Zainol,Christopher Paul Aisu

The court established that publications must be considered in context to determine if they are defamatory, emphasizing responsible journalism and the necessity of proving all elements of defamation.

Headnote:(A) Defamation Law - Elements of defamation - The court found that the respondents failed to prove the elements of defamation regarding the publications made by the appellants, leading to a reversal of the High Court's decision awarding damages. (Paras 20, 42, 72, 74)

(B) Responsible Journalism - The appellants established that they acted as responsible journalists, verifying information from multiple sources before publication, thus applicable defenses such as justification were upheld. (Paras 63, 70)

Facts of the case:
The appellants, a television broadcasting company and its employees, published news reports alleging the respondent was involved in a scam related to vending machines, leading to a lawsuit for defamation.

Findings of Court:
The court found that the publications did not contain defamatory statements about the respondent, and the High Court erred in its findings.

Issues: The main issues included whether the statements made were defamatory and whether the appellants acted responsibly in their journalism.

Ratio Decidendi: The court concluded that the statements, when read in context, did not imply that the respondent was involved in any wrongdoing, and thus the elements of defamation were not satisfied.

Result: Appeals allowed, and the High Court's decision was overturned.
