AWARD
In determining a dispute between Syarikat Kenderaan Melayu Kelantan Bhd. (hereinafter referred to as "the Company") and the Transport Workers' Union (hereinafter referred to as "the Union") over the dismissal of Encik Ridzuan Bin Mat Deris (hereinafter referred to as "the 1st Claimant") and Encik Yazit Bin Mamat (hereinafter referred to as "the 2nd Claimant"), the Industrial Court handed down an Award ( Award No. 38/92 ) ordering the Company to pay (1) to the 1st Claimant the sum of $9,660 and to the 2nd Claimant the sum of $27,280.80 within one month from date of the award subject to income tax deductions, if any.
On 13 April 1992, the Union lodged a complaint of non-compliance of the award against the Company under s. 56(1) of the Industrial Relations Act 1967 , in that the Company had failed to pay to the two Claimants the amount ordered. It then prayed for an order of non-compliance against the Company.
When the case came up for hearing on 31 July 1992, the Union informed the Court that the Company had settled the amount. It then requested for an Award. We see no objection to the Union's request and make an award accordingly.
