Ini adalah satu rayuan oleh Pendakwa Raya terhadap perintah Mejisteret Jelebu, membebaskan dan melepaskan ketiga-tiga responden dibawah seksyen 173(g), Kanun Acara Jenayah, sebelum pihak pendakwa menyelesaikan kes dakwaannya (close of prosecution case).

Ketiga-tiga responden pada asalnya dituduh di Mahkamah Mejisteret di Jelebu dibawah seksyen 457, Kanun Keseksaan. Pada 13hb April, 1981, pihak pendakwa telah mengemukakan tuduhan yang dipinda terhadap ketiga-tiga responden bersama-sama. Tuduhan yang dipinda tersebut berbunyi seperti berikut:

"That you on July 4, 1979 at about 10.00 p.m. at Kampong Kuala Klawang, in the District of Jelebu, in the State of Negeri Sembilan, committed lurking house trespass by night in order to the committing of an offence punishable with imprisonment to wit by voluntarily causing hurt to one Mokhtar bin Zainon NRIC 5292681(B) and that you have thereby committed an offence punishable under section 458 of the Penal Code to be read together with section 34 of the Penal Code."

Ketiga-tiga responden tersebut tidak dibela oleh peguambela. Tuduhan yang dipinda tersebut telah dibaca dan diterangkan kepada mereka dan mereka minta dibicarakan.
