[1] This is a reference by The Honourable Minister of Human Resources of Malaysia dated 23 July 2019 pursuant to s 20(3) of the Industrial Relations Act 1967 which was received by the Industrial Court of Malaysia on 29 July 2019 arising out of the alleged unlawful dismissal of KARIM BIN MOHAMAD ROTHI (hereinafter referred to as the "Claimant") by UAC BERHAD (hereinafter referred to as the "Company") on 14 March 2019.
Factual Background
[2] The Claimant joined the services of the Company vide letter dated 27 August 1997 (pp 5-6 of COB-1) as a probationary General Factory Hand Grade IV commencing duties on 2 September 1997 with as salary of RM317.00 per month with a probationary period for six months. He was confirmed in his employment vide letter of confirmation of appointment dated 26 February 1998 (p 7 of COB-1) and his basic salary was increased to RM400.00 per month. During the tenure of his employment and after few upgraded of his position, he last position as General Factory Hand Grade IV - Sheet Handler with his last drawn salary of RM1,800.00 per calendar month before his dismissal on 14 March 2019.
