[1] This is a reference made under s 20(3) of the Industrial Relations Act, 1967 arising out of the dismissal of Gan Boon Sun ("the Claimant") by JMB Perdana Exclusive and Tropics ("the Respondent").

[2] This application is filed by the Claimant after the hearing has started on 28 November 2018 and at the stage of the cross examination of COW 2, the Claimant filed in Form P as prescribed under r 21B the Industrial Rules 1967 (Rule 1967) which states:

"21B. Notice to produce documents

(1) The Court may, if it appears desirable in the interest of justice and upon an application being made, order by way of summons any party

(a) To state on oath orally or by affidavit about documents he has or he has had in his possession or power relating to the matters in question; and

(b) To produce any documents in his possession or power

(2) A summons to produce documents shall be in Form P."
