The appeal herein is against the decision of the Learned Senior Assistant Registrar given on the 2nd September 2002 dismissing the Defendant's application to strike out the Plaintiff's Writ and Statement of Claim pursuant to Order 18 Rule 19(1) of the Rules of the High Court 1980.
Background Facts :-
The facts leading to this appeal are not in dispute.
The plaintiff used to work for the defendant. She was an Account Collector and her duties, in brief, involved, inter alia, collecting from clients of the defendant, payments for goods supplied to them by the defendant.
On 13.9.2001, the defendants terminated the contract of
employment of the plaintiff. A letter dated 14.9.2001 Exhibit PW1 in Enclosure 14 was issued to this effect and sent to all the clients of the defendants in which it was stated;
"Kepada Sesiapa yang berkenaan. Per: Misliha Lagiman (Liena)
Ini adalah dimaklumkan bahawa Bill Collector di atas
tidak lagi berkhidmat dengan Syarikat Linguaphone
Distributors Sdn Bhd berkuatkuasa daripada 01 hb
September 2001. Dengan ini beliau tidak lagi mempunyai kuasa
mengambil wang atau apa-apa bayaran atau barangan/
set Linguaphone daripada pelanggan dan Syarikat
