Award No: 1330 of 2013 [Case No: 4/3-1135/10]

Union's allegations regarding the abuse of VSS and the employment of contract workers lack sufficient evidence and do not constitute a trade dispute under the Industrial Relations Act.

(C) Importance of union's prior consultation with members emphasized; court found adequate communication prior to VSS implementation -

(D) The employment of contract workers was found to be within the company's managerial prerogative and not an unfair labour practice - (E) Burden of proof resides with the union, and their claims regarding VSS and contract employment lacked substantiation. (Paras 1, 6, 22, 34)

[5] I shall now deal with the subject matter in dispute.

[6] In essence, the union's dispute with regard to the minister's reference is two fold:

Voluntary Separation Scheme (VSS)

Did The Company Force Or Abuse The VSS Against The Union Members Employees?
