INDUSTRIAL COURT KUALA LUMPUR
KOK YU MING – Appellant
Versus
COSMOS DISCOVERY SDN BHD – Respondent
Award No: 620 Of 2014 [Case No: 25(22)/4-656/07]

Retrenchment due to bona fide organizational changes is valid; employers must substantiate claims of redundancy with clear evidence of operational necessity.

Headnote:(A) Industrial Relations Act 1967 - Sections 30(5) - Retrenchment due to organizational restructure - Claimant dismissed from the position of Marketing Manager on grounds of redundancy following the Company's operational shift to China - The retrenchment was done bona fide as it was due to insufficient sales generated and the closure of the Marketing-Sales Department in Malaysia. (Paras 86, 75, 69)

(B) Natural justice - The retrenchment was argued to contravene principles of natural justice; however, the Court found the Company adhered to lawful procedures concerning the retrenchment, including proper notification and compensation. (Paras 86, 81)

(C) Burden of proof - It is incumbent upon the employer to demonstrate actual redundancy; the Court concluded that the Company provided adequate evidence justifying the retrenchment. This included a detailed examination of financial performance and managerial decisions regarding the necessity of the Claimant's role. (Paras 64, 66, 72)

Facts of the case:
The Claimant began employment with the Company in December 2003 and was confirmed in February 2004. She was dismissed in July 2005 when the Company decided to downsize operations in Malaysia due to poor sales performance. The Claimant contended that her dismissal was unjust and claims were initiated to challenge this dismissal.

Findings of Court:
The Court ruled that the Company's actions in retrenching the Claimant were justified, formalities were complied with, and the decision to close the Marketing-Sales Department was bona fide.

Issues: The main issues addressed included the validity of the retrenchment due to redundancy, the truthfulness of the reasons for retrenchment, and whether proper procedures were followed in executing the dismissal.

Ratio Decidendi: The Court held that retrenchment based on bona fide reorganization does not equate to unfair dismissal, and verified that the Company met the burden of proof regarding the redundancy, underscoring the importance of managerial discretion in an employer's operational decisions.

Result: Claim dismissed.

Evaluation And Findings

[61] It is trite law as decided by the Federal Court in Goon Kwee Phoy v. J & P Coats (M) Sdn Bhd, that in dismissal cases where the employer chooses to give a reason for the action taken by him, the Industrial Court cannot go into another reason not relied by the Company nor find one for it.

[62] In this case, the reason for dismissal as per page 8 CLB is that of retrenchment due to the reorganisation and downsizing of its Malaysian operations. The Company had due to poor sales decided to refocus its business to China and close its Marketing Sales Department in which the Claimant was employed making her position redundant.

[63] Retrenchment as decided by the Court of Appeal in William Jacks & Co (M) Sdn Bhd v. S Balasingam, is "the discharge of surplus labour or staff by the employer for any reason whatsoever otherwise than a punishment inflicted by way of disciplinary action".
