The parties in this case are Luminal Sdn. Bhd. (hereinafter referred to as "the company") and Kimbi ak Ebet (hereinafter referred to as "the claimant"). The claimant alleged that he had been dismissed without just cause or excuse on 6 December 2001.

This case was set down for mention on 23 October 2004. On this day, the claimant was requested to file statement of case; thus is fixed for further mention on 21 December 2004. On this day, the claimant was absent and no statement of case is filed. In the premise, the court accordingly orders the claim of the claimant be struck off with liberty to file afresh.
