Reference

[1] This is a reference made under s 20(3) of the IRA 1967 ("the Act") arising out of the dismissal of Siti Asmahan Mohd Ali (hereinafter referred to as "the Claimant") by Pendidikan Industri YS Sdn Bhd (hereinafter referred to as "the Company") on 12 March 2021.

The Parties

[2] The Claimant commenced employment with the Company in 2001 as a lecturer in the Faculty of Industrial Management (Fakulti Pengurusan) at Universiti Industri Selangor (UNISEL) operated by the company.

[3] The Claimant was promoted to the post of Senior Lecturer (Pensyarah Kanan) with effect from 18 September 2007 with a monthly salary of RM5,500.00.

[4] The Claimant's last drawn salary was RM8,656.10.

The Dispute

[5] On 13 November 2020, the Claimant had issued a comment in the WhatsApp group "FOB Wing B" as follows:

"Unisel ini dah tak betul. Tadi akak doa untuk Unisel dah 20 tahun tapi basic HR Rule pun x boleh ikut mcm mana nak berkat? Mana ada University dalam dunia ni Dekan repot to TNCA malam tidur sesame. At faculty level mana ada ketua jabatan report psda TDA malam tidur sesame. Pastu ada juga husband and wife satu faculty. Cuba u all fikir. Semua decision w
