COURT OF APPEAL PUTRAJAYA
JOSU ENGINEERING CONSTRUCTION SDN BHD – Appellant
Versus
TSR BINA SDN BHD – Respondent
[Civil Appeal No: N-02-417-02-2013]
The appeal succeeded as the High Court erred in dismissing the appellant's claims while allowing unsupported counterclaims.
Headnote:This judgment analyzes the appeal against a High Court decision on two subcontracts involving construction works. The findings indicate the appellant's claims for unpaid works under both the Earthworks and Site Office Subcontracts were unjustly dismissed by the High Court, highlighting errors in fact appreciation. The court frames issues around the contractual obligations and counterclaims related to construction works. The court concludes that the appellant is entitled to recover unpaid amounts while dismissing the counterclaims from the respondent.
Result: It is ordered that the appellant be paid RM87,502.07 and RM258,585.20 for the respective subcontracts, with additional interest.
