GROUNDS OF JUDGMENT

Introduction

[1] This claim is basically that of a disgruntled partner in a law firm, the plaintiff, against her former partner, the first defendant. However, since the partnership assets were held by a private limited company, the 2nd defendant, the plaintiff is also seeking reliefs from this defendant. In addition, since the 1st defendant was a director of the 2nd defendant the plaintiff is also making a claim against him in this capacity.

Background

[2] To fully understand the plaintiff's claim, which is poorly presented both in pleadings and in evidence, I shall have to start with the background facts.

[3] The plaintiff is and was at all material time an advocate and solicitor. In October 1992, she ventured out on her own and started a sole proprietorship firm called Ms M. Mages & Associates (the said firm). Before this, she was attached to another law firm where she came to know the 1st defendant, who was a client. At the time when the plaintiff set up the said firm, the 1st defendant, though a businessman was studying law in Australia.
