Background of these 2 cases

Both Cases No. 5/4-1544/05;, [2006] 3 ILR 1916, [2006] 4 ILR 2914 and No. 6/4-1694/05 were initially referred to the Industrial Court and scheduled to be heard in Court No. 5 and Court No. 6 respectively. The Claimant in Cases No. 5/4-1544/05;, [2006] 3 ILR 1916, [2006] 4 ILR 2914 is Amran Ramakrishnan bin Abdullah (hereinafter referred to as 'the 1st Claimant') and the Claimant in Case No. 6/4-1694/05 is Murugan a/l Suppiah (hereinafter referred to as 'the 2nd Claimant'). Pursuant to an Award of this Court videAward No. 1449 of 2006 handed down on 15.8.2006, Case No. 6/4-1694/05 was ordered to be consolidated with Cases No. 5/4-1544/05;, [2006] 3 ILR 1916, [2006] 4 ILR 2914 and that both cases were ordered to be heard jointly in this Court ie, Court No. 5.

Prior to the consolidation of both Cases No. 5/4-1544/05;, [2006] 3 ILR 1916, [2006] 4 ILR 2914 and No. 6/4-1694/05, videAward No. 1100 of 2006, handed down by this Court on 21.6.2006 upon a Notice of Application filed by the 1st Claimant, this Court has allowed the 1st Claimant's Application to join the Official Receiver/ Liquidator and Gim Capital Sdn. Bhd. as parties to this proceeding. He
