[1] Prosiding di hadapan Mahkamah ini adalah lanjutan daripada rujukan yang dibuat oleh Menteri Sumber Manusia, Malaysia di bawah s 20(3) Akta Perhubungan Perusahaan 1967 , berhubung dengan pembuangan kerja Jillian Kathleen Gallyot ("Yang Menuntut") pada 10 Julai 2019 oleh Everlantern Sdn Bhd ("pihak Syarikat").
[2] Di dalam tuntutan ini, Yang Menuntut mendakwa perkhidmatan beliau telah ditamatkan secara terancang (constructively terminated) oleh pihak Syarikat berkuat kuasa pada 10 Julai 2019 iaitu tidak sampai 4 bulan selepas beliau memulakan perkhidmatannya dan belum melepasi tempoh percubaan.
