This is a complaint under s. 56(1) of the Industrial Relations Act 1967 made by Bernard Martin Bok ("the claimant") of non-compliance of Award No. 28/96 handed down on 19 January 1995 ("the award") by Mechmar Heavy Industries Sdn. Bhd. ("the company").

The award ordered the company to pay backwages and compensation amounting to RM58,800 within a month from 19 January 1996, the date of the award.

The claimant filed Form S dated 3 June 1996 complaining of non-compliance of the award.

The case was mentioned on 20 June 1996 and fixed for hearing on 13 August 1996.

When the case was called this morning, Puan Deepinder Kaur, Counsel for the company applied for an adjournment on the ground that she had just been retained - on or about 29 July 1996. She needed time to get instructions from client whether they could get money from other subsidiaries. The company has been dormant since 1991. Cik Shamini objected to any postponement as a postponement would deprive the claimant from getting the benefit of the order early. As this matter is only a matter of non-compliance she did not think that the company needed any adjournment.
