INDUSTRIAL COURT KUALA LUMPUR
AHMAD SIVAKUMAR ABDULLAH – Appellant
Versus
ASPEN GLOVE SDN BHD – Respondent
Award No: 217 Of 2023 [Case No: 22/4-2692/21]
Dismissals of probationers do not require prior warning letters as per established industrial jurisprudence, provided the dismissal is justified.
Headnote:(1) The Industrial Relations Act 1967, s 20(3) mandates the court to determine if a dismissal occurred and if it was with or without just cause. The Claimant, employed on probation, was terminated due to performance issues, without prior warnings as established procedures are flexible for probationers. (2) This case examined whether dismissal was justified based on the Claimant's alleged poor performance during his probation period. The court determined on the balance of probabilities that the Claimant's assertions of confusion and lack of guidance were unfounded. (3) Consequently, the court upheld the dismissal, affirming that the termination did not constitute malice or caprice.
