Petitioner Advocates:Tan Lee Kiat,Chua Chong Theng ,Respondent Advocate: Sharifullah Majeed,Arissa Ahrom

Dismissal due to undisclosed conflicts of interest and violation of company policies constitutes just cause under industrial relations law.

Headnote:The Court determines the dismissal's just cause concerning Ghazali Bin Abdullah’s employment with FGV Plantations under s 20 of the Industrial Relations Act 1967. The Claimant was alleged to have violated the employer's Code of Conduct through undisclosed conflicts of interest involving his employment with another company. The findings indicate that the Claimant's actions constituted misconduct warranting dismissal. The legal issues center on whether established misconduct justified dismissal and the burden of proof rests with the employer to demonstrate disciplinary justification. The Claimant's appeal against the dismissal was ultimately dismissed by the Court, affirming the Company's grounds for termination.
