Award

1 On 31 July 1984, the Industrial Court handed down an Award (Award No. 189/84) on wages and terms and conditions of employment binding on Asia Plywood Co. Sdn. Bhd., Sungei Patani (hereinafter referred to as "the Company") and the Timber Employees' Union, Peninsular Malaysia (hereinafter referred to as "the Union") for a period of three years and two months, effective from 1 November 1983 to 31 December 1986.AfterAward No. 189/84 had expired, the Union submitted a fresh proposal to the Company with a view to entering into a collective agreement binding on them.They met but failed to reach any accord.They then made a joint application to the Minister of Labour to have their dispute referred to the Industrial Court for adjudication.The Minister made his Reference on 17 October 1987

2 At the commencement of the proceedings, the parties informed us that they had amicably settled most of the articles in Union's Statement of Case, except the following:

(a) Duration&Termination of Award;

(b) Salary Scales;

(c) Salary Conversion;

(d) Special Relief Allowance;

(e) Bonus;

(f) Public Holidays;

(g) Retirement&Retirement Benefits; and

(h) Stoppage&Shutdown
