AWARD

This was a reference by the Honourable Minister of Human Resources pursuant to s. 20(3), Industrial Relations Act 1967 arising out of the dismissal of Encik Lee Seu Leong (hereinafter referred to as "the claimant") by Fung Keong Rubber Manufactory (M) Sdn. Bhd. (hereinafter referred to as "the company") on 8 April 1999.

The hearing commenced on 25 March 2004 and continued for 3 days. The hearing was concluded and the parties were directed to submit written submissions.

The court was informed by both parties that the claimant had passed away. The brother of the claimant informed the court that the claimant had passed away on 26 October 2004.

The representative for the claimant withdrew the claim as it abated upon the death of the claimant.

The claim was dismissed.
