INDUSTRIAL COURT, KUALA LUMPUR
TELEKOM PUBLICATIONS SDN BHD – Appellant
Versus
RAZLAN RIDWAN – Respondent
Award No. 1780 Of 2004 [Case No: 13/4-1643/04]

AWARD

This case involved the dismissal of Encik Razlan bin Ridwan by his employer Telekom Publications Sdn. Bhd. on 16 April 2003 and the matter was referred to the Industrial Court for an award on 12 July 2004 under s. 20(3) of the Industrial Relations Act 1967 .

The case was first mentioned on 5 October 2004 and the company was represented by Ms Hazlina Mohd. Isa whilst the claimant was absent. Court was informed that process server attempted to serve notice of mention on claimant on 23 September 2004 but was unable to serve the notice.

When the case was called at the next mention on 29 October 2004, Court was informed that attempt to reach the Industrial Relations Department for the latest address was in vain. Court requested staff to make another attempt to obtain the latest address of claimant from the Industrial Relations Department.

When the case was called up for mention again on 9 December 2004 Court was informed that the Industrial Relations Department had given a telephone number of the claimant but the attempts by Court staff to get through to the claimant was not successful as the telephone number was no longer in service.

Company's counsel then requested the Court to strike out the claimant's case in the light of the above circumstances.

Case struck off with liberty to file afresh within 6 months.
