MAHKAMAH TINGGI MALAYA MELAKA
LIM BENG SENG LWN. PENTADBIR TANAH DAERAH ALOR GAJAH
[Perujukan Tanah No: 15-87-2008]

Compensation for expropriated land is determined by market value and lawful structures. Unlawful improvements do not warrant compensation under the Land Acquisition Act.

Headnote:(A) Land Acquisition Act 1960 - Sections 40D(3) and 49(1) - Amount of compensation for land expropriation - The court ruled that compensation decisions under section 40D are final and not appealable, emphasizing that market value assessments must reflect true land value and lawful structures only. (Paragraphs 4, 5, 15, 19)

(B) Valuation Methodology - The court confirmed that compensation calculations should be based on recent comparables and lawful land usage, with the absence of planning permission affecting compensation eligibility. (Paragraphs 10, 15)

(C) Role of Assessors - The court acknowledged that the decisions of appointed assessors are binding, reinforcing the statutory mechanism under section 40 of the Act for evidentiary purposes in determining compensation amounts. (Paragraphs 17, 19)

Facts of the case:
The applicant contested the initial compensation of RM113,630.00 for land expropriated for industrial use, asserting the amounts offered did not reflect fair market values or consider all relevant property improvements.

Findings of Court:
The court increased the compensation for land and residential building while confirming relocation costs, but denied claims for unlawful structures.

Issues: The main issues included whether the compensation reflected true market value and the validity of claims for structures built without permission.

Ratio Decidendi: The court reasoned that compensation assessments must comply with legal standards, focusing on market rates and lawful constructions. The absence of proper permits negated claims for certain structures.

Result: Compensation increased; unlawful structure claims denied, with interest of 8% awarded on additional amounts.
