This is a reference made under subsection 20(3) of the Industrial Relation Act 1967 arising out of the dismissal of NOR AZMINI BINTI MD. YUSOF (hereinafter referred to as "Claimant") by SKYNET WORLDWIDE (M) SDN. BHD. (hereinafter referred to as the "Company") on the 7.7.2003.

AWARD

THIS REFERENCE was fixed for continue hearing this morning on 28 April 2008. Mr. Sukhdev Singh from Messrs. A. Sivanesan & Co counsel for the Claimant and Mr. R. Jeyendran from Messrs. R. Jeyendran & Co counsel for the Company inform the Court that the parties have amicably resolved this reference on the following terms and conditions:

1. Without an admission to liability the Company has agreed to settle with the claim as full and final settlement of this matter with the payment of the sum of RM44,100 (RINGGIT MALAYSIA: FORTY FOUR THOUSAND AND ONE HUNDRED ONLY).

2. The Claimant has agreed to accept the said sum of RM44,100 (RINGGIT MALAYSIA: FORTY FOUR THOUSAND AND ONE HUNDRED ONLY) as full and final settlement.

3. The Claimant undertakes not to make any further claim arising from this claim.

4. The Company undertakes to make out a cheque for the said sum of RM44,100 (RINGGIT MALAYSIA: FORTY FOUR THOUSAND AND ONE HUNDRED ONLY) in the name of the Claimant's solicitor Messrs. A. Sivanesan & Co within 2 weeks from the date of the issuance of the award.

UPON CONFIRMATION of the said terms by the parties, the Court accordingly handed down an award upon the terms as agreed to by consent indicated above.
