Headnote:(A) Trade Description Act 1972 - Section 16 - Trade Marks Act 1976 - Sections 35, 38, and 46 - Trade mark infringement - The court upheld the High Court's decision allowing the respondent's trade description order and rejecting the appellants' efforts to remove the registered trade mark 'Squiggles' - The appellant's mark 'Squiggle' was found to be confusingly similar to the registered trade mark, creating a likelihood of consumer deception - The appellant lacked also the standing to challenge the registration of the respondent's trade mark in the absence of evidence of prior ownership or lawful continuous use - The registration of the mark was confirmed by the trade mark registrar and met statutory requirements. (B) Trade Mark Ownership - The court ruled that the registration confers exclusive rights to the registered owner against unauthorized use, affirming that registered users have specific protections under the statute and a common law claim is insufficient to establish standing to remove a registered trade mark.
