[1] The appellant and respondent are parties to an ongoing arbitration in Penang. The parties by agreement required the arbitrator to make an interim award on several preliminary issues which the parties wanted determined prior to the hearing of the arbitration proper. The learned arbitrator made the interim award dated 31st December 2009 (see p 562 of Bahagian Jilid 7).
