HIGH COURT MALAYA KUALA LUMPUR
BANK ISLAM MALAYSIA BERHAD – Appellant
Versus
HELCOM ENGINEERING CORPORATION SDN BHD & ORS – Respondent
[Guaman No: D-22A-23-2011]

Islamic banking contracts remain valid unless challenged on recognized legal grounds; plaintiffs need only establish a prima facie case for obtaining summary judgment.

Headnote:(A) High Court Rules, 1980 - Order 14 - Cash Note Facility - Application for final judgment by Plaintiff against Defendants for RM9,956,799.62 due under the Cash Note Facility as of 31 October 2010 with imposed ta'widh - Defendants failed to service payments and challenged the legality of Islamic banking practices applied by Plaintiff. (Paras 1, 7, 10)

(B) Summary Judgment - Function is to assess parties' proof to determine necessity for trial - Plaintiff must establish a prima facie case for judgment - Burden then shifts to Defendants to show a triable issue. (Paras 11, 12)

(C) Shariah Compliance - Court held that arguments against enforceability based on Islamic law were unsustainable as contract validity was upheld absent proven vitiating factors. (Paras 18, 22, 39)

(D) Legal Sufficiency of Letter of Demand - Court accepted that demand was validly served based on proof exhibited - Defendants’ denial without elaboration deemed non-viable. (Paras 45) (E) Certificate of Indebtedness - Court ruled no manifest error presented by Defendants, thus upheld the Plaintiff's certificate. (Paras 46)

Findings of Court:
Plaintiff established a prima facie case, and Defendants lacked substantive defenses to negate the claims for outstanding debt under the Cash Note Facility. (Paras 11, 17)

Issues: Whether the Cash Note Facility complied with Shariah, necessity of proving receipt of the Letter of Demand, and legitimacy of the Certificate of Indebtedness. (Paras 10)

Ratio Decidendi: Court emphasized that Islamic banking contracts maintain validity unless challenged by demonstrable vitiating factors and upheld the enforcement of terms agreed upon in the contract. (Paras 18, 22, 39)

Result: Application allowed with costs; judgment rendered in favor of Plaintiff.
