In this case Chuah Chong Tit (hereinafter to be referred as 'the claimant') brought an action against U.S. Feed Grains Council (hereinafter to be known as 'the company') on his dismissal which he considered wrongful, against the principles of natural justice and unlawful.

The claimant was appointed as a technical manager with effect from 6 February 1995 on a salary of RM50,762 per annum and was to be on probation for six months as in CO1 pp. 1 to 3. For ease of reference the appointment letter is appended be below:
