[1] This is an application by way of Summons In Chambers dated 22.4.2009 (Enclosure 52) by the Menteri Besar Negeri Pahang Darul Makmur, the applicant (hereinafter referred to as 'the MB Pahang') to stay the enforcement of the order of mandamus directed against the MB Pahang to pay the judgment sum of RM 37,471.60 million and interest (hereinafter referred to as 'the said order') by His Lordship Hj. Abdul Halim Bin Aman J. on 20.4.2009 as per the said Order (Enclosure 65). This application for stay pending the appeal by the MB Pahang to the Court of Appeal is against the said order. His Lordship Hj. Abdul Halim Bin Aman J. had upon hearing the application (Enclosure 4) of Seruan Gemilang Sdn. Bhd., (hereinafter referred to as 'the SGM') the respondent in this application (Enclosure 52) allowed the relief sought by SGM to direct the MB Pahang to pay the said judgment sum and interest which was obtained on 25.5.2007 in Civil Suit No. 21-9-2002 against the Pahang State Government and the State Director of Forestry, Pahang.
